DEEPAK GUPTA , J.(Oral) By way of this peon filed under Arcle 227 of the Constuon of India, challenge was given to the order dated 11.02.2026 (Annexure P-19), whereby learned Civil Judge (Jr. Divn.), Batala directed the appointment of a Local Commissioner in a civil suit bearing No.CS-1250- 2025, tled as “M/s Kailash Mechanical Works & another v. Maninder Singh Bal @ Manjinder Singh and others”. Another prayer is made in the peon to direct the trial Court to dispose of the applicaon under Order 39 Rules 1 & 2 CPC, expediously. 2. However, it is conceded by learned senior counsel for the peoner that a@er filing of the present revision peon, the report of the Local Commissioner has already been received and therefore the relief qua challenge to the order dated 11.02.2026 (Annexure P-19) has become infructuous. 3. However, learned senior counsel for the peoner has pressed to direct the trial Court to dispose of the applicaon under Order 39 Rules 1 & 2 CPC, expediously by keeping in mind the status of the peoner at the me of filing of the suit. 4. The aforesaid prayer made by learned counsel for the peoner appears to be quite reasonable and genuine. As such, the present SARITA RANI 2026.03.11 15:08 I attest to the accuracy of this document/order  CR-1918-2026 - 2- 2026:PHHC:037136 revision peon is hereby disposed of with a direcon to the trial Court concerned to dispose of the applicaon under Order 39 Rules 1 & 2 CPC, by keeping in mind the status of the peoner at the me of filing of the suit. Since this order has been passed without issuing noce to respondents, in order to avoid the delay, therefore, they will be at liberty to approach this Court, in case, they feel aggrieved by this order.
