JUSTICE GIRIJISH KUMAR ORAL ORDER 2 19-08-2026 Heard learned counsel appearing on behalf of the parties. 2. The present contempt application has been filed alleging non-compliance with the order dated 07.02.2017 passed in C.W.J.C. No. 166 of 2016, whereby this Court had directed the respondents to undertake recounting of the ballot papers. 3. It has, however, been stated in paragraph 10 of the supplementary show-cause filed on behalf of the opposite parties that a massive fire broke out in the office of the Assistant Registrar, Co-operative Societies, Samastipur, on 13.11.2026, as a consequence whereof the ballot box and other records relating to the PACS Election of Samastipur Block were damaged. It has, therefore, been submitted that compliance with the direction for recounting of the ballot papers has become difficult. 4. Be that as it may, the order alleged to have been violated was passed as far back as on 07.02.2017. The matter has remained pending for several years and, in view of the Patna High Court MJC No.1917 of 2017(2) dt.19-08-2026 3/3 passage of considerable time, no fruitful purpose would now be served by keeping the present contempt application pending. 5. In view of the aforesaid, nothing further survives for consideration in the present contempt application. Accordingly, the contempt proceeding is dropped against the opposite party. 6.
