JUSTICE MANOJ JAIN O R D E R % 11.02.2026 1. Applicant seeks regular bail in FIR No. 326/2020 registered under Section 302 IPC, 1860 at P.S. Narela. 2. He is charged with committing murder of his wife, who died of asphyxia due to ante-mortem strangulation. 3. As per the allegations, the accused and deceased were together previous night and in the morning, when it was learnt that murder had taken place, the accused was nowhere in the sight and had absconded. 4. Incident is of the night intervening 01.08.2020 and 02.08.2020 and the accused was arrested on 05.08.2020 and is in custody since then. 5. Charges have already been framed and admittedly, out of the 26 cited prosecution witnesses, 12 witnesses have already been examined. 6. All the material public witnesses, including the relatives of the deceased, have graced the witness box, already. 7. It is informed that there was one material public witness, in the neighbourhood, who had seen the accused leaving his residence in the early hours of the morning but, unfortunately, she expired before her deposition This is a digitally signed order. The completion of trial would still takes some time as 14 more witnesses are yet to be examined. 9. The nominal roll of the accused indicates his age as 35 years, with no previous involvement of any kind. 10. He is in continuous incarceration for last 5 ½ years. 11. Keeping in mind overall facts and his incarceration, albeit, without expressing any opinion over the merits of the case, applicant is hereby admitted to bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court, Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions: - (i) Applicant shall not try to contact any witness, directly or indirectly. (ii) Applicant shall report to the SHO of the local area, once a month on Sunday at 10:00 AM and shall not leave the National Capital Region of Delhi without prior permission of learned Trial Court. (iii) Applicant shall furnish mobile number to concerned IO on which he can be contacted, if required. Such number shall remain operational and functional. 12. Application stands disposed of in aforesaid terms. 13. A copy of this Order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance.
