The applicant seeks anticipatory bail in case arising out of FIR No.484/2024 dated 18.10.2024 registered at P.S. Special Cell for commission of offences under Section 318(2)/318(4)/61(2)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 417/420/120B/34 of IPC). 2. Learned Addl. P.P. for the State appears on advance notice and submits that the case is of serious magnitude as the victim was cheated of a sum of approximately 53 lacs. He submits that substantial amount had landed in one IDFC Bank account held in the name of Shivansh General Trading Company. When Vipin @ Vikas @ Shubham was interrogated, he revealed the name of the present applicant and claimed that the details of the account in question were provided to him against some consideration. 3. It is submitted by prosecution that earlier applicant was permitted to join investigation by the learned Court of Sessions but he did not cooperate in the desired manner and did not give any satisfactory response about his mobile phone and vaguely claimed that he had lost the same in some accident whereas there is no report to the abovesaid effect. It is submitted that the mobile details were collected from concerned service provider and it was found that the mobile is still active. 4. Learned Addl. P.P. for the State also submits that since the applicant did not join investigation thereafter, proceedings have already been initiated against him to declare him an absconder. He submits that, therefore, the custodial interrogation is very much required to unearth conspiracy related to cyber crime in question and to connect several missing dots. He has also taken me through the supplementary disclosure statement of Vipin @ Vikas @ Shubham recorded on 07.06.2025. In his such statement, it has been claimed that the financial transaction used to be conducted by the applicant i.e. Deepak @ Shiva, who also revealed that on one instance, a sum of Rs.10-15 lacs was withdrawn in cash from the account and such proceeds were thereafter distributed. Learned Addl. P.P. also submits that the bank account in question is involved in several other cases of cyber crime and, therefore, he does not deserve to be released on anticipatory bail, particularly, when accused Vipin @ Vikas @ Shubham, who has already been arrested, This is a digitally signed order. Keeping in mind the overall facts of the case and also the fact that the case is related to a cyber crime, custodial interrogation of the applicant would be imperative.
