Heard learned counsel for the petitioners and learned Additional Government Advocate for the State. 3. The petitioners are in custody since 11th November, 2025 in connection with Padampur P.S. Case No.334/2025 corresponding to G.R. Case No-1252/2025 pending in the Court of learned S.D.J.M., Padampur for the alleged commission of the offence under Sections-331(3)/305/3(5) of the BNS Act. 4. It is alleged that the petitioners, taking advantage of the absence of informant, broke into his house and committed theft of cash and several gold ornaments. It is submitted that the petitioners have been implicated on suspicion only. 5. Learned State counsel refers to the statement of some witnesses to submit that they are the eye-witnesses to the occurrence. 6. On perusal of the case records and the statements of the eye- witnesses, it is seen that the statements are almost similar and parrot-like, which by itself casts a doubt. Nevertheless, considering the fact that most of the stolen articles have since been recovered and the petitioners have spent nearly six months in custody and charge-sheet has been submitted, I am inclined to take a lenient view. Let the petitioners be released on bail on such terms and conditions as the Court below may deem fit and proper to impose including the condition that they shall appear before the trial Court on each date of posting of the case and in case of even a single default, necessary orders shall be passed by the Court below to take them to custody again. 8. The BLAPL is disposed of. 9. Urgent certified copy of this order be granted on proper application.
