JUSTICE R.K. PATTANAIK Order No. ORDER 07.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Tangi P.S. Case No.341 of 2025 corresponding to G.R. Case No.317 of 2025 pending in the court of learned J.M.F.C., Chilika on the grounds stated. 3. Perused the FIR as at Annexure-1. A case under Section 303(2) BNSS has been registered for a report alleging therein about theft of BTS Card cost of Rs.1.8 lac from a tower by unknown miscreants. The petitioner apprehends arrest in the hands of the police, who is having antecedents. It is claimed that the petitioner is not involved as the tower is under the maintenance of one Tusarkant Routray. Recorded the submission of learned counsel for the State. The FIR reveals that the above named as an employee was in charge of the tower and he has not been alleged of having committed theft. Considering the loss suffered on account of alleged theft, this Court is not inclined to consider the plea of pre-arrest of the petitioner, who is at liberty to surrender before the learned court below seeking regular bail and in case of rejection, to approach the Sessions Court for orders. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders within a fortnight from today before learned J.M.F.C., Chilika in connection with Tangi P.S. Case No.341 of 2025 corresponding to G.R. Case No.317 of 2025 and moves regular bail, it shall be duly considered and in case rejected during the first hour, he shall approach the Sessions Court during the second hour for orders on the same day and for the said purpose, the lower court record shall be made available without delay. 6.
