2. An application under Section 13B of Hindu Marriage Act was filed, jointly by petitioner and his wife, which was allowed by learned Principal Judge, Family Court, Dehradun, vide
judgment dated 04.07.2024, their marriage was dissolved by mutual consent; custody of the son Master Vihan Thapa was given to respondent (wife), however, petitioner was given right to visit his son once in a month and also to keep his son during vacation with him.
3. According to petitioner, the respondent is not permitting him to visit his son nor petitioner has been permitted to keep his son for some days during vacation, therefore, petitioner moved an application seeking execution of the judgment and decree dated 04.07.2024.
4. By means of this writ petition, petitioner has sought a direction to the
court concerned to decide pending Execution Petition No. 07/2025, expeditiously.
5. Having regard to the
facts and circumstances of the case, the writ petition is disposed of with a request to the court concerned to make endeavour to decide the execution application, as early as possible, preferably within six months from the date of presentation of certified copy of this order.
