M. SAPTHAGIRI Counsel for the Respondent(S): 1. GP FOR HOME The Court made the following: -3- W.P. No.1915 of 2026 THE HON’BLE SRI JUSTICE SUBHENDU SAMANTA WRIT PETITION NO: 1915/2026 ORDER: 1. Instant writ petition is preferred seeking necessary direction to the concerned respondent authority in opening and continuing rowdy sheet No.100 in Tekkali Police Station, against petitioner. 2. It is the contention of learned counsel for the petitioner that crime registered against petitioner had already ended in acquittal by the order of concerned Sessions Judge in the year 2001. Since then, police authority has been continuing rowdy sheet by initiating specific proceedings under several sections of Cr.P.C. Learned counsel further submits that present petitioner is in no way connected with any offence and has not been involved in any untoward incident in that locality. Thus, at this juncture, continuation of the rowdy sheet is not maintainable and the same is required to be quashed. 3. Learned Assistant Government Pleader for Home submits that rowdy sheets were issued as the petitioner was connected with a case of murder, attempt to murder and assault with dangerous weapons, time and again, though all the crimes and the sessions cases have been disposed of by the order of acquittal, to maintain law and order and tranquility in the locality, rowdy sheet has been continued. -4- W.P. No.1915 of 2026 4. It has been frankly submitted by learned Assistant Government Pleader, particularly, in paragraph 8 of the counter, that mainly to safeguard the residents of the locality, rowdy sheet is being continued. 5. Having heard learned counsel for the parties and considering the fact that present petitioner is aged 66 years and is not involved in any crime, moreover, respondent authority concerned has not placed any material to show that petitioner was involved in any offence or heinous offence for which rowdy sheet could be connected. Accordingly, I am of the view that petitioner deserves a favourable order. 6. Under the above observation, instant writ petition is disposed of. The rowdy sheet No.100 of Tekkali Police Station, issued and continued against petitioner is hereby quashed. No costs. 7. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ________________________________ JUSTICE SUBHENDU SAMANTA Dt.04.05.2026 BV
