Counsel for the petitioner submits that infact no such incident as alleged has occurred and as per the interrogation report of the petitioner, the prosecutrix “U” has called the petitioner and both of them had slept in separate rooms and this fact has been corroborated by the Investigating Officer-PW8- Mahendra Singh. Counsel submits that there is no evidence against the petitioner to show that any sexual intercourse has been committed by him with the prosecutrix “U”. He further submits that after submission of charge-sheet, statements of prosecutrix and other relevant witnesses have also been recorded. 2. Lastly he argued that as per the statement of Investigating Officer -PW8-Mahendra Singh, the proseuctrix “U” went with the petitioner on her own volition and wanted to return to her home at her own desire. Hence under these circumstances, no case is (2 of 2) [CRLMB-1913/2026] made out against the petitioner. Counsel further submits that trial will take its own time to conclude, hence indulgence of bail be granted to the petitioner. 3. Per contra, learned Public Prosecutor opposed the prayer. 4. Looking to the gravity of the matter and the allegations levelled against the petitioner by the prosecutrix “U” and also looking to the age of the prosecutrix, this Court is not inclined to enlarge the petitioner on bail. 5. Accordingly, the second bail application stands dismissed. 6. It is expected from the Trial Court to make all possible endeavours to conclude the trial expeditiously as early as possible.
