Order No.
ORDER 07.04.2026
01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Golanthara P.S. Case No. 537 of 2023 corresponding to G.R. Case No.1793 of 2023 pending in the court of learned J.M.F.C.(Rural) Cog. Berhampur on the grounds stated. 3. Perused the FIR as at Annexure-1. Referring to the medical examination report i.e. Annexure-2, it is submitted that the injured, namely, Balaram Patra did not receive any external injury, hence, considering the same, the petitioner should be allowed to go on bail with conditions. Recorded the objection of the State. The petitioner and another accused had earlier approached this Court in ABLAPL No.3565 of 2024 disposed of on 23rd April, 2024 denying pre-arrest bail to them but followed by a direction to surrender before the learned court below seeking regular bail. Today, it is informed to the Court
that the chargesheet was filed after 23rd April, 2024, the date on which, the earlier ABLAPL was disposed of, hence, under the changed circumstance with the closure of investigation, the petitioner should be allowed to surrender and to go on bail with any conditions as deem just and proper in the facts and circumstance of the case. Recorded the objection of the State. Considering the aforesaid development with the filing of the chargesheet, the alleged incident being of the year, 2023, notwithstanding the earlier ABLAPL disposed of in the month of April, 2024, this Court is inclined to direct the petitioner to surrender before the learned court of learned J.M.F.C.(Rural) Cog. Berhampur to go on bail with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C.(Rural) Cog. Berhampur within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No.1793 of 2023 on furnishing a bail bond of Rs.20,000/- (rupees twenty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 6. Issue urgent certified copy of this order as per rules.
