1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the petitioner and learned Addl. Government Advocate for the State.
3. The Petitioner is in custody since 24th January, 2026 in connection with Khallikote P.S. Case No.55/2026 corresponding to G.R. Case No.145/2026 pending in the Court of learned J.M.F.C., Khallikote for the alleged commission of the offence under Sections 109/115(2)/118(1)/126(2)/296/351(3) of BNS, read with section 25(1-A)/27(2) of the Arms Act.
4. It is alleged that the petitioner assaulted the tractor driver of the informant by means of a sword causing bodily injury. Learned counsel for the petitioner further submits that the injury was not on any vital part of the body but was on the palm and finger. He further submits that the injury sustained by the injured is simple in nature.
5. Learned State Counsel opposes the prayer for bail by submitting that the petitioner has five criminal antecedents. In response, the learned counsel for the petitioner submits that all these cases relate to of the year 2021, in which the petitioner has

been released on bail.
6. Considering the submissions made, the materials on record and the period of detention of the Petitioner in custody and the fact that the injury sustained by the injured is simple in nature, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case and in case of even a single default, necessary orders shall be passed by the court to take him to custody again.
7. The BLAPL is disposed of.
8. Urgent certified copy of this order be granted on proper application.
