ORDER Date : 24.08.2026 Heard Mr. M. Ahmed, learned counsel for the petitioner. Also heard Mr. M.P. Goswami, learned Addl. Public Prosecutor, Assam for the State respondent.
2. The order dated 18.08.2026 requires the petitioner to bring on record all the passed orders, passed by the learned trial Court in the trial proceedings against the petitioner in connection with NDPS Case No. 13/2025 (arising out of Bhuragaon P.S. Case No. 89/2024) under Sections 20 (b)(ii)(c)/ 29
Page No.# 2/2 of the NDPS Act, pending in the Court of the learned Sessions Judge, Morigaon. The said orders have been brought on record by filing an additional affidavit.
3. Mr. M. Ahmed, learned counsel for the petitioner has submitted that the next date fixed for trial is on 14.09.2026 on which date the petitioner shall appear before the learned trial Court.
4. In view of the submissions of the learned counsel for the petitioner, the non-bailable warrant of arrest issued against the petitioner by the learned trial Court shall remain in-abeyance till 14.09.2026, on which date the petitioner shall appear before the learned trial Court. On moving of an appropriate application for bail, the learned trial Court shall take into account the attending
facts and circumstances and consider the prayer made by the petitioner to be allowed to remain on bail.
5. It is made clear that this Court has not made any observation regarding the merit or demerit of the case for allowing the petitioner on bail. The same shall be decided by the learned trial Court on the appearance of the petitioner.
6. Anticipatory bail application accordingly closed.
