IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No.1905 of 2026
Prabhasini Bhuyan and another
… Petitioners
Mr. S.K. Bhanjadeo, Advocate -versus- State of Odisha … Opposite Party Mr. R.B. Mishra, Addl. PP
CORAM: JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL):23.04.2026
02.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a bail application U/S.483 of BNSS by the petitioners for grant of bail in connection with Kabisuryanagar PS Case No.540 of 2023 corresponding to ST Case No.55 of 2024 (GR Case No.528 of 2023) pending in the file of learned Additional District and Sessions Judge, Kodala, Ganjam, for commission of offences punishable U/Ss.302/34 of IPC r/w Sections 25(1-B)(a)/25(1-B)(b)/27(1) of Arms Act, on the main allegation of committing double murder of Mithun Bhuyan and Subrat Swain @ Lipu by assaulting them with lethal weapons, along with co-accused persons.
3. Heard, Mr. Sanjib Kumar Bhanjadeo, learned counsel for the petitioners and Mr. R.B. Mishra, learned Additional Public Prosecutor in the matter and perused the record together with the copy of the order passed by the Apex Court in Criminal Appeal No.____ of 2026 arising out of SLP(Crl.) No.12035 of 2025.
4. Admittedly, the petitioners are in custody since 06.09.2023, but co-accused Kuni Bhuyan standing on similar footing has already been granted bail by the Apex Court in the referred SLP(Crl.). Besides, this Court while refusing bail to the petitioners has granted liberty to them to renew their prayer for bail, if the trial is not concluded within six months from the date of receipt of copy of the order passed in BLAPL No.1064 of 2025 on 11.07.2025 and in the meantime, more than six months have elapsed. In the aforesaid premises, when there is remote possibility of trial being concluded in near future, this Court without expressing any view on merits admits each of the petitioners to bail.
5. Hence, the bail application of the petitioners stands allowed and the petitioners are allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
6. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e- mail for reference.
