The present petition has been filed by the Petitioner - Mr. Abhimanyu Lall under Articles 226 and 227 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondent No.1- Registrar Co-operative Societies (hereinafter, ‘RCS’) to expeditiously decide the appeal of the Petitioner under Section 139(2) of the Delhi Co-operative Societies Act, 2003 (hereinafter, ‘DCS Act’). 3. The Petitioner is a member of the Evergreen Co-operative Group Housing Society, Plot No. 9, Sector 7, New Delhi (hereinafter, ‘the Society’). 4. The Petitioner has appeared in person and it is his case that there are various illegalities being committed by the Society. In view thereof, he had filed two applications requesting for certain information from the Society. 5. The first application was filed by the Petitioner on 10th July, 2025 This is a digitally signed order. Authorized and sanctioned layout plan of Evergreen CGHS Ltd., Plot No. 9, Sector-7, Dwarka, New Delhi — 110075, with accurate dimensions and planning approvals. 2. Authorized and sanctioned building plan with accurate dimensions of Flat Nos. 110 and 111 of the society. 3. Authorized and sanctioned plan/map with accurate dimensions of all 2 BHK Flats within the society. 4. Authorized and sanctioned plan/map with accurate dimensions of all 3 BHK Flats within the society. 5. Authorized and sanctioned plan/map with accurate dimensions of all 4 BHK Flats within the society. 6. Authorized and sanctioned map with accurate dimensions of the Society Office. 7. Authorized and sanctioned plan/map with accurate dimensions of all parks and green areas in the society. 8. Authorized and sanctioned plan/map with accurate dimensions of the Temple constructed inside the society premises.” 6. Thereafter, the second application was filed by the Petitioner on 15th October, 2025 wherein the following information was sought: “1. Whether any actual work and methodology decided by the Managing Committee and whether any expert advice were sort from competent This is a digitally signed order. The Order is downloaded from the DHC Server on 13/02/2026 at 11:16:45 architect and contractors (in terms of clause 4 of the AGM held on 26.02.2023)? if yes, provide copies of actual work and methodology decided by the Managing Committee and the copies of the expert advice sort from experts i.e. competent architect and contractors. 2. Was any tender called for / floated in terms of clause 4 of AGM held on 26.02.2023? If yes:- a) In which official gazette / newspaper / magazine / website were the tenders published / floated? b) Provide Copies of the tenders called in regard to the clause 4 of the AGM Weld on 26.02.2023. 3. To whom the tender was allotted? Give copy of detailed work order given by the managing committee to the contractor. 4. List of details of work carried on for beautification of front boundary wall with granite work with led light signage, plaster work, parapet wall repair and revamping of boundary walls. 5. List of details of item wise/ block wise work done by the contractor in terms of clause 4 of the AGM held on 26.02.2023. 6. Copy of completion report submitted by the contractor in terms of clause 4 of the AGM held on 26.02.2023. Copies of bills raised by the contractor in terms of clause 4 of AGM held on 26.02.2023. 8. Copies Of receipt of payment made to the contractor in terms of clause 4 of the AGM held on 26.02.2023. 9. Before and after pictures of the repair work conducted, in terms of clause 4 of the AGM held on 26.02.2023.” 7. Since the Petitioner did not receive any replies from the Society, to the aforesaid applications, he filed an appeal under Section 139 (2) of the DCS Act before the RCS. The same was filed on 26th November, 2025. The grievance of the Petitioner is that despite repeated applications, no notice has been issued in the appeal and the matter has not been taken up by the RCS. 8. Ms. Harshita, ld. Counsel on behalf of the RCS submits that the office of RCS was earlier short-staffed. However, staff has been appointed in the RCS office now. It is submitted that the RCS would take an expedited decision in the appeal preferred by the Petitioner. 9. Accordingly, let the RCS decide the appeal filed by the Petitioner within a period of 6 weeks. Let the same be decided after providing proper hearing to the Society. 10.
