For Petitioner : Mr.A.Gopinath Government Advocate (Criminal Side) For Respondent : Mr.R.Thamaraiselvan 1/6 https://www.mhc.tn.gov.in/judis Crl.M.P.No.1901 of 2025 O R D E R This petition has been filed by the State, represented by the Deputy Superintendent of Police, Economic Offence Wing-II, Salem, seeking to cancel the anticipatory bail granted to the accused Number 3, who is the respondent herein by this Court, vide order dated 23.01.2020 in Crl.OP.No.34828 of 2019. 2.Mr.A.Gopinath, learned Government Advocate (Criminal Side) would contend that the respondent has been granted anticipatory bail by this Court subject to the condition that the respondent shall deposit a sum of Rs.6,05,000/- (Rupees Six Lakh and Five Thousand Only) within a period of two weeks from the date of receipt of a copy of this order dated 23.01.2020, however, till date the respondent has not complied with the said order and also failed to comply with his own undertaking given by him before the Special Court stating that he would settle the amounts payable to the depositors within a period of two months. He would also submit that the respondent has not co-operating with the investigating agency, however indulging in similar criminal activity and also attempting to tamper with the evidence and also trying to dispose of his assets in order to defeat the 2/6 https://www.mhc.tn.gov.in/judis Crl.M.P.No.1901 of 2025 depositors. Therefore, the learned Government Advocate (Criminal Side) would urge this Court to cancel the anticipatory bail granted by this Court. 3.The learned counsel for the respondent would submit that due to financial crisis, the respondent had not complied with the order. However, he is co-operating the investigating agency and also attending the proceedings as and when required. He would further submit that Mr.M.Thangarajan, District Judge, who has been appointed as member of the committee, had passed away and new committee was formed and in the meantime, the respondent could make the payment in compliance with the order of this Court. He further submitted that the petitioner is complied the conditions as ordered by this Court dated 23.01.2020 in Crl.OP.No.34828 of 2019. 4.Considering the submissions made by the learned Government Advocate as well as the learned counsel for the petitioner and taking note of the fact that despite sufficient time was granted, the respondent has failed to comply with the condition imposed by this Court while granting anticipatory bail and since the respondent has to comply with the condition precedent for grant of anticipatory bail, this Court is inclined to cancel the same. 3/6 https://www.mhc.tn.gov.in/judis Crl.M.P.No.1901 of 2025 5.
