1. By this petition, the petitioner herein is seeking a direction upon the respondent Nos. 2 to 4 to consider and decide his case with regard to the exchange of Shop No. MA-216 (360 Sqft. First Floor, Module A, Sangarmall City Centre, Srinagar) with Shop No. A-102 (197 Sqft. Ground Floor, Module A, Sangarmall City Centre, Srinagar).
2. It is stated that the petitioner was allotted Shop No. MA-216 measuring 360 Sqft on the first floor of Module A/Craft Bazar at Sangarmall City Centre, M.A Road, Srinagar vide allotment order dated 29.06.2015. Pursuant to the premium fixed, the petitioner deposited an amount of Rs. 52,75,000/- with the respondents.

Learned counsel for the petitioner submits that, since the petitioner has not been able to earn any income from the said allotted shop, therefore the respondents may either reimburse the amount deposited by the petitioner or provide the petitioner an alternate shop with less dimensions, so that he may be able to pay a lesser amount of rent on monthly basis.
4. Learned counsel for the petitioner submits that he has already filed a detailed representation on 30.09.2023 seeking exchange of Shop No. MA- 216 with Shop A-102, but the same has not been decided by the respondents till date.
5. Learned counsel for the petitioner submits that the petitioner would file a fresh representation, which may be directed to be considered.

Learned counsel for the petitioner further submits that the petitioner herein would feel satisfied in case the instant petition is disposed of at this stage, with a direction to the respondents to consider the representation to be filed by the petitioner, by passing a speaking order thereon within some reasonable timeframe.
7. Be that as it may, the instant petition is disposed of, without expressing any opinion on the merits of the case, with a direction to the respondents to consider and decide the petitioner’s representation to be filed by him within two weeks time from today, with regard to exchange of Shop No. MA-216 (360 Sqft. First Floor, Module A, Sangarmall City Centre, Srinagar) with Shop No. A-102 (197 Sqft. Ground Floor, Module A, Sangarmall City Centre, Srinagar), by passing a speaking order thereon within a period of six weeks from the date representation is received by them.
8. Disposed of in the manner indicated above.
