The present Writ Petition has been filed under Article 226 of the Constitution of India, read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for a Writ in the nature of Habeas Corpus for the production of Mr. Amit Dalal, the brother of the petitioner. Suspicion of his disappearance was cast on the respondent no. 2, his wife. 2. On 06.07.2026, when the petition was first listed before us, the This is a digitally signed order. learned Standing Counsel for the State had handed over a copy of the Status Report dated 06.07.2026, wherein, it was, inter alia, stated that during the inquiry it had been found that Mr. Amit Dalal has been admitted to a Non-Governmental Organization [‘NGO’], namely ‘Sahaj Sambhav’, in relation to de-addiction and rehabilitation. 3. Ms. Rekha Jhingan, the Administrator of the said Centre, had joined virtually and assured us that Mr. Amit Dalal shall be produced before us on the next date of hearing, which we fixed as 09.07.2026. 4. On 09.07.2026, Mr. Amit Dalal was produced before us from the said NGO, and he complained that he had been confined in the above NGO without his consent. He had stated a desire to live with the petitioner, his brother. As he was a major, we had allowed him to do so. 5. Mr. Gurdeep Singh had also appeared from the NGO. 6. As Mr. Amit Dalal had raised a grievance about his illegal confinement at the NGO, we had called upon the said NGO to produce before us the necessary permissions and licenses to operate a de- addiction centre. 7.
This Court had also issued notice to the respondent no. 2 at whose instance Mr. Amit Dalal had been admitted to the said NGO. 8. Today, the respondent no. 2 has appeared in person and she submits that Mr. Amit Dalal had an addiction to alcohol and drugs and it was for his own well-being that he had been admitted to the said NGO at her behest. The same is denied by Mr. Amit Dalal. 9. Be that as it may, Mr. Amit Dalal is now staying with the petitioner. question of fact, leaving Mr. Amit Dalal and the respondent no. 2 to avail of their remedies in this regard in accordance with law. 10. The present petition is disposed of in the above terms. 11. As far as the Sahaj Sambhav, NGO is concerned, Mr. Bhola Shankar has appeared before us from the said NGO. He has produced before us a copy of the Registration Certificate issued by the Registrar of Societies, as also the admission and other documents as far as Mr. Amit Dalal is concerned. 12. The learned counsels for the respondent no. 1 have advised us that for running a de-addiction centre, permissions from the Directorate General of Health Services, Government of NCT of Delhi and a Licence from the concerned Drug Department would be required. No such permission or Licence has been produced by Mr. Bhola Shankar before us today. He is also not aware if the NGO has any such permission or Licence in hand. 13.
As we are not satisfied on whether Sahaj Sambhav, NGO is possessing any permissions/License required to run a de-addiction centre, and as in absence thereof, it may even turn out to be more harmful than helpful to the persons who need such help, we direct the Director General Health, Directorate General of Health Services, Government of NCT of Delhi, to enquire into whether Sahaj Sambhav, NGO has the necessary permissions and approvals for running a de-addiction centre and if not, direct necessary action against them in accordance with law. Report of such enquiry and further action taken must be placed before us within a period of four weeks from today. This is a digitally signed order. 14. In such an inquiry, needless to state, Sahaj Sambhav will be given an opportunity of hearing and to produce necessary documents. 15. A copy of this order be communicated to the Director General Health, Directorate General of Health Services, Government of NCT of Delhi, by the Registry of this Court for necessary compliance. 16.
