(1) The West Bengal State Council of Higher Education Act, 1994 shall stand repealed with effect from the date of coming into force of this Act. (2) Subject to such repeal, the existing Council, its Chairman, Vice-Chairman and all other members as constituted and appointed under the erstwhile West Bengal State Council of Higher Education Act, 1994 and any rules, regulations or orders made thereunder, shall unless repugnant to the provisions of this Act, continue to be valid, unless otherwise modified. (3) Anything done or intended to be done by the Council immediately before coming into operation of this Act, and in pursuance of the erstwhile West Bengal State Council of Higher Education Act, 1994 and any rules, regulations or orders made thereunder, shall unless repugnant to the provisions of this Act, continue to be valid, unless otherwise modified. (4) All moneys and other properties and all rights, liabilities and interests of whatever kind, owned by, vested in, used, enjoyed or possessed by, or held in trust by or for, the Council constituted under the erstwhile West Bengal State Council of Higher Education Act, 1994 as well as all liabilities legally subsisting against the Council shall continue with the Council under this Act, unless otherwise provided.
