Where any building or wall, or anything affixed thereto, or any well, tank, reservoir, pool, depression or excavation or any branch of tree is, in the opinion of the Chief Executive Officer dangerous to persons passing by or dwelling or working in the neighbourhood, the Chief Executive Officer may, by notice in writing, require the owner or the occupier thereof to remove the same or may require him to repair, protect or enclose the same in such manner as he thinks necessary and if the danger is, in the opinion of the Chief Executive Officer, imminent, he shall forthwith take such steps as he thinks necessary to avert the same. And on failure of compliance with the notice for removal and abatement of the nuisance or the danger, the offender may be imprisoned or fined to the extent of rupees five hundred and daily fine of rupees fifty. 360 The Siliguri Municipal Corporation Act, 1990.
