For section 38, the following section shall be substituted, namely:— "38. The power conferred on the Sessions Judge by clause (ii) of section 37 shall be exercised subject to the control of the High Court and the State Government and the power conferred on the District Magistrate by clause (ir) of that section shall be exercised subject to the control of the State Government.".
