If in any case before a Nyaya Panchayat the petitioner fails to Dismissal appear on the day fixed, or if in the opinion of the Nyaya Panchayat, for default. he shows negligence in prosecuting his case, the Nyaya Panchayat may dismiss the case for default, and such order of dismissal shall operate as an acquittal.
