Whenever a Dafadar or a Chowkidar arrests any person under section 39 he shall forthwith take the person so arrested to the police-station having jurisdiction over the area in which the arrest is made: Provided that if the arrest is made at night such person shall be so taken, as soon as convenient, by the following morning.
