I in any case before a Nyaya Panchayat, the petitioner fails to appear on the <lay :fi.xe<l, or if iu the opinion of the yaya Panchayat he shows negligence in prosecuting his case, the Nyaa Panchaayat may dismiss the case for defuult, nncl such order of dismissal shall operate as an acquittal.
