(1) The Development Authority may give public notice of its intention to declare that— (a) in any street or portion thereof specified in the notice, the elevation and construction of the frontage of all buildings or any class of buildings erected or re-erected after such notice shall, in respect of their architectural features, be such as the Development Authority may consider suitable to the locality ; or (b) in any locality specified in the notice, there shall be allowed the erection of only detached or semi-detached buildings or both or row- houses and that the land appurtenant to each such building shall be of an area being not less than that specified in the notice ; or (c) the division or sub-division of building plots in a particular locality shall be of a specified size ; or (d) in any street, portion of a street, or locality specified in-the notice, the construction of any one or more of the different classes of buildings like residential, commercial, business, assembly, mercantile, indus- trial, institutional, storage or hazardous buildings, shall not be al- lowed without the special permission of the Development Authority. (2) The Development Authority shall, at a meeting, consider all the sugges- tions or objections received within a period of three months of the publication of the notice under sub-section (1), and may confirm the declaration or may modify "it; so, however, that no such modification shall extend the effect of such declaration. (3) The Development Authority shall, in the manner prescribed, publish any declaration so confirmed or modified, and such declaration shall take effect from the date of such publication. (4) No person shall, 'after the date of publication of such declaration, erect or re-erect any building in contravention of such declaration. (5) The Development Authority shall ensure that such declaration is in conformity with the provisions of any Development Plan, if in force, under the West Bengal Town and Country (Planning and Development) Act, 1979.
