(1) Every person, who intends to construct, reconstruct, alter, stop up, or obstruct any private drain, shall send to the Commissioner an application for permission to execute the work. (2) Every such application shall be accompanied by a general description of the drain. (3) The permission referred to in sub-section (1) may be granted or refused or may be granted subject to any conditions which the Commissioner may think fit to impose in accordance with such rules as may be made in this behalf. (4) No construction, reconstruction, alteration, or stoppage of, or obstruction to, any private drain shall be commenced without the permission, in writ;ng, of the Commissioner.
