The provisions of this chapter and the rules and the regulations made thereunder relating to erection of buildings shall not applied to necessary repairs not involving any of the works, which constitute a material addition and alteration. Explanation.—An addition to, or alteration of, a building shall be deemed to be material if it— (a) increases or diminishes the height of the area covered by, or affects the cubical contents of the building or any part thereof; or (b) affects of likely to affect prejudicially the stability and safety of building in respect of sewerage, drainage, ventilation and environmental safety; or (c) converts the building or any part thereof from one "occupancy" or "use" to another "occupancy" or "use"; or (d) is an addition or alteration as defined in the rules and regulations made under this chapter. 114 THE KOLKATA GAZETTE, EXTRAORDINARY, MAY 29, 2008 [PART III The West Bengal Municipal Corporation Act, 2006.
