(1) Whenever, in the opinion of the State Government, it becomes necessary to make provisions for regulation of urban growth in any non- municipal urban area, identified as such in the latest Census Report, the State Government may, by notification, entrust a Gram Panchayat or a Panchayat Samiti, as the case may be, constituted under the West Bengal Panchayat Act, 1973, with powers and duties to enforce all or any of the provisions of this Act or the rules made thereunder on matters relating to— (a) building regulations, (b) street alignment, (c) conversion of land or building from one use to another, and (d) public safety and nuisance. (2) The exercise of any power or discharge of aDv duty entrusted on a Grain Panchayat or a Panchayat Samiti under sub-section (1) shall, notwithstanding anything contained in the West Bengal Panchayat Act, 1973, be deemed to be the performance of the functions assigned to the Gram Panchayat or the Panchayat Samiti, as the case may be, in respect of the matter referred to in clause (o) of sub-section (1) of section 20, or item (ii) of clause (a) of sub-section (1) of section 109, as the case may be, of that Act.
