(1) If any tank, pond, well, hole, stream, dam, bank or other place appears to the Board of Councillors to be, for wain of sufficient repair, protection or enclosure, dangerous to the passers-by or to persons living in the neighbourhood, the Board of Counicllors may be notice Precautions in case of dangerous trees. Precautions in case of dangerous tanks, well, holes, etc. 347 The West Bengal Municipal Act, 1993. [West Ben. Act Power to stop dangerous quarrying. Precautions against fire. (Part VIIL—Community Health—Chapter XXI— Public Safety and Nuisances.—Sections 330, 331.) require the concerned owner to fill in, remove, repair, protect or enclose such tank, pond, well, hole, stream, dam, bank or other place, as the case may be, to prevent any danger therefrom whithin such period as may be specified in the notice. (2) If immediate action in respect of any tank, pond, well, hole, stream, dam, bank or other place referred to in sub-section (1), is necessary, the Chairman-in-Council shall, before giving such notice or before the period specified in the notice expires, take such temporary measures as it may think fit to prevent danger, and the cost of doing so shall be recoverable from the owner as an arrear of tax under this Act.
