(1) Notwithstanding anything contained in any other law for the time being in force, no member of a co-operative housing society, who has been allotted a plot of land or a house or an apartment in a multi- storied building, shall let out such plot of land or house or apartment, as the case may be, and receive any compensation or income in respect of the plot of land or house or apartment, as the case may be, without the written consent of the co-operative housing society on an application made in this behalf. The co-operative housing society may give its consent or refuse such consent for reasons to be recorded in writing and communicate its decision to the member within one month from the date of receipt of his application. (2) If the co-operative housing society fails to take decision on the application within one month from the date of its receipt or refuses such consent, the member shall have a right of appeal to the Registrar. 362 The West Bengal Co-operative Societies Act, 1983.
