(1) The State Government may by general or special order in power't° remit certain the case of any co-operative society or class of co-operative societies duties, fees, remit any tax, cess or fee payable under any law for the time being in egtrca.n,tand to force or the rules framed thereunder in respect of which the State preference, Government is competent to remit such tax, cess or fee. exemption and concession. (2) In respect of any co-operative society or class of co-operative societies, the State Government may,— (a) by notification in the Official Gazette, remit— (i) the stamp duty (other than stamp duties falling within entry 91 or entry 96 in List I in the Seventh Schedule to the Constitution), in respect of any instrument executed by, or on behalf of, or in favour of, a co- operative society or by an officer or on behalf of a member thereof and relating to the business of such society, in cases where, but for such remission, the co- operative society, officer or member thereof, as the case may be, would be liable to pay the stamp duty chargeable under any law for the time being in force in respect of such instrument, and (ii) any fee payable by a co-operative society, under any law for the time being in force, for the registration of documents; (b) notwithstanding anything contained in any other law for the time being in force, by general or special order, grant— (i) preference in the matter of settlement of lands and fisheries owned by the State Government, (ii) preference in the matter of making purchases and fixing prices thereof, (iii) preference in the matter of placing contracts for Government work without inviting open tenders, (iv) exemption from deposit of earnest money required to be made along with submission of tenders for Government contract work, (v) exemption from deposit of security money required to be made before being allowed to take up Government contract work for execution, (vi) exemption from payment of licence fees, if any, required to be paid for dealing in any commodity, and 191 The West Bengal Co-operative Societies Act, 1973.
