for the proviso to sub-section (3) of section 241, the following proviso shall be substituted, namely:— "Provided that if the owner or occupier proves that any such structure or fixture was erected before the date of the commencement of the Chander- nagore Municipal Act, 1955, the Magistrate shall order reasonable compensation to be paid to any person who suffers damage by the removal or alteration thereof. In determining the amount of compensation the value of the land shall not be taken into consideration.";
