(1) Any person, who— (i) contravenes the provisions of section 3, or (ii) being the holder of Class A license sells milk in excess of five seers on any one day, or (1,) ct fi The West Bengal Cattle Linens?ng Act, 1959. I of 1959.1 (Sections 13,14.) (iii) keeps cattle in any premises or place differen1 from that mentioned in the -license, or (iv) keeps cattle in excess of the maximum number or different in description from that stated in the license, or (v) violates or fails to observe the conditions referred to in sub-section (5) of section 5, shall be punishable with imprisonment for a term which may extend to six months or with fine not exceeding one thousand rupees or with both. (2) Every offence under this Act' shall be cognizable and bailable. (3) Where a person is convicted of any offence under this section the Court may direct that the cattle in respect of which the ofrence is committed shall be forfeited to Government. (4) The Court may also in any case where cattle have been seized under section 11, direct that the owner thereof shall pay the cost of seizure and of transport of the cattle, and the expenses for their custody and maintenance and the sum directed to be so paid shall be realised as if it were fine.
