When any premises is used or is permitted io be used by any person Tor any purpose other than lhat for which a licence has been granted under sub-section (1) of scclion 435 or as a stable or a cattle-shed or a cow-house, then such person shall, without prejudice loany other penally to which he may be subject, be liable to a fine which may extend, in lhe case of a masonry building, to two hundred and fifty rupees and, in the case of a hut, to twenty-five rupees, and, in ihc case of continuance of such use, to a further fine which may extend, in ihc case of a masonry building, to fifty rupees and, in the case of a hm, to five rupees for each day during which such use continues after the first day.
