NoLwithslancling anything contained in section 562 when lhe occupier of any premises pays any instalment of improvemeni expenses, he shall, subject io any agreemeni lo the contrary between himself and Lhe owner of such premises, be entitled to deduct the amount of such instalment from the rent payable by him to such owner or lo recover the same From such owner in pursuance of any order of a court of competent jurisdiction.
