(I) The Municipal Commissioner may, by a general order or by an order lo affect such portion or '[Kolkaia] as may be specified therein, prohibit— (a) the making of excavaiions for the purpose of taking with earth therefrom or of storing rubbish or offensive matter therein, and (b) the digging af cesspools, tanks, ponds, wells or pi Is without his special permission. (2) No person shall make any excavation referred lo in clause (a) or sub- seclion (I) or dig any cesspool, lank, pond, well or pil in contravention of any such order. (3) IT any such excavation, cesspool, lank, pond, well or pil is made or dug after lhe publication of any such order and wilhoui llie permission required thereby, lhe Municipal Commissioner may, by written notice, require the owner or occupier of lhe land on which the same is made or dug lo fill it up wiih earth or olher material approved of by him.
