(1) No place which has not previously been lawfully used or registered as a place for the disposal or the dead shall be opened by any person for the said purpose except in conformity with the provisions oT Die Wesl Bengal Town and Country (Planning and Development) Acl, ]979 and wilhoul the written permission of the Municipal Commissioner who. wilh the approval of lhe Mayor-in-Council, may grant or withhold such permission. (2) Such permission may be subjeel to such conditions as lhe Municipal Commissioner may ihink fit io impose Tor the purpose or preventing any annoyance lo, or danger lo ihc health of. any person residing in the neighbourhood. (3) No place for the disposal of the dead which has fallen into disuse shall be used again as such.
