Act ill In lhe '[Kolkaia] Municipal Act, 1923, as extended Lo the Municipality of 1923. of Howrah.— (a) section 127 shall be renumbered as sub-section (I) of thai section and after sub-section (1) as so renumbered, Lhe following sub-section shall be inserted ;— "(2) The value of any plant or machinery excepling those enumerated in Schedule VIA or furniture which may be on any land or in any building shall nol be taken into consideration in estimating the annual value of such land or such building under this section: Provided that— (a) if any dispute arises as Lo whether any parts ofa plant or a combination of plant and machinery should be included in estimating the annual value of any land or building as coming within the enumeration in Schedule VIA, the Commissioners at a meeiing may, of their own motion or ai the request of the owner or the occupier of such land or such building, refer the dispute lo a reference named in a panel of reference appointed by the Slate Government in this behalf; (b) the referee shall thereupon decide the dispute after giving Lhe Commissioners, the owner and the occupicr an opportunity of being heard, and after considering the facts and circumstances of the case and, if necessary, after inspection or the plant or machinery, and the decision of Lhe referee shall be final and conclusive; (c) the cosL of the reference shall be borne by the Commissioners and the owner or both Lhe owner and the occupier in such proportion as the referee may direct."; (d) in seclion 189, after sub-seciion (3), the following sub-section and Explanation shall be inserted :— "(4) If the amounl for which any bill has been presented under this section is paid within seven days from such presentation into the municipal office or lo a municipal officer appointed Lo receive lhe same, a rebate of three and one-eighth percent of such amounl shall be allowed to lhe payer.
