(l)The Municipal Commissioner may, al any lime during the erection of any building or the execution of any work or at any time within three months after [he completion thereof, by a written nolice, specify any mailer in respect of which such erection or execution is without or contrary lo the sanction referred to in section 396 or is in contravention of any condition of such sanction or of any of [he - 'Section 401A was inserted by s. 2 of the Calculla Municipal Corporation (Second The Kolkata Municipal Corporation Act, 1980. 783 LIX ori980.] (Part VI.—Town Planning, Land and Land Use Controls.— Chapter XXH.—Buildings.—A. General Powers.—Seclion 404.) provisions of this Act or the rules or lhe regulations made thereunder and require Lhe person who gave the noiice under seclion 393 or section 394 or lhe owner of such building or work either— (a) lo make such alterations as may be specified by the Municipal Commissioner in the notice wilh lhe object of bringing the building or Lhe work in conformity wilh such sanction or such condition of such sanction or such provisions of this Acl or lhe rules or the regulations made thereunder, or (b) to show cause, within such period asmay be stated in the notice, why such alterations should not be made. (2) If such person or such owner does nol show any cause as aforesaid, he shall be bound to make the alterations specified in the notice. (3) If such person or such owner shows lhe cause as aforesaid, the the Municipal Commissioner shall, by an order, either cancel lhe notice issued under sub-section (1) or confirm the same subjeel io such modifications as he thinks fit.
