If any sireel has been levelled, paved, metalled, flagged, channelled, sewered, drained, conserved and lighted under scclion 367, the Municipal Commissioner may, and, if the sireel is not less lhan six metres in width, on lhe requisition of a majority of the owners referred lo in sub-scclion (I) of that section, shall, declare such street Lo be a public street and [hereupon the street shall vest in the Corporation: 'Provided Lhat, where a private street has been in existence for not less than thirty years and is used by Lhe people of the locality as a thoroughfare, the Corporation may declare such sireel io be a public street even though it does not strictly comply with the provisions of this Chapter.
