(I) If any building which abuts on a public street is in the rear of the regular line of such slreel, the Municipal Commissioner may. whenever it is proposed— (a) io rebuild such building, or 754 The Kolkaia Municipal Corporaiii'n Act, 1930. (b) io alter or repair such building in such manner as will involve the removal or re-erection of such building, or portion thereof which abuts on such street, to an extent measured in cubic metre exceeding onc-Ualf of such building or portion thereof above the ground level. by an order as respects the rebuilding, alteration or repair of such building or portion ihereoT, permit or, with the approval of the Mayor-in- Council, require such building to be set forward lo the regular line of such street, (2) For the purposes ol" this seciion, a wall separating any premises from a public street shall be deemed to be building; and it shall be deemed io be a sufficient compliance with the permission or the requirement to set forward a building to lhe regular line of a street, if a wall of such materials and dimensions as are approved by the Municipal Commissioner is crccled along such line.
