(1) If il appears to ihe Municipal Commissioner lhai lhe only or most convenient means of waler-stipply lo, and drainage or, any premises is by placing or carrying any pipe or drain over, under, along or across lhe immovable property of another person, the Municipal Commissioner, after giving 'he owner of llie immovable property a reasonable opportunity of staling any objection, may, if no objection is raised or if any objection which is raised appears to him invalid or insufficient, by an order in writing, authorise (he owner or the occupicr of lhe premises io place or carry such pipe or drain over, under, along or across such immovable property in such manner as he may think Tit io allow. (2) Upon lhe order in writing under sub-seciiou (1), lhe owner or lhe occupier or lhc premises may, after giving reasonable notice in writing of his intention so to do, enter upon the immovable property wiih assistants and workmen al any time between sunrise and sunset for lhe purpose of placing a pipe or drain over, under, along or across such immovable property or for the purpose of repairing lhe same. (3) In respeel of Lhe execution of any work under ihis seciion, lhc person in whose favour the Municipal Commissioner's order is made shall be subject to lhe same restrictions and liabilities which are specified in sub-seclion (4) of section 306. (4) If lhe owner of the immovable properly over, under, along or across which a pipe or drain has been placed or carried under this seciion whilst such immovable properly was nol built upon desires to crcct any building on such properly, the Municipal Commissioner shall, by noiicc in writing, require the owner of the premises lo close, remove or divert the pipe or drain in such manner as may be approved by him and lo fill in, reinstate and make good the immovable properly as in the pipe or drain had not been placed or carried over, under, along or across the same: Provided thai no such requisition shall be made unless in the opinion of lhc Municipal Commissioner il is necessary or expedient for lhe construction or the proposed building or (he safe enjoyment thereof that the pipe or drain should be closed, removed or diverted.
