(1) Any person desiring to drain his premises into a municipal drain through a drain of which he is not an owner may make a privale arrangement wilh lhe owner for permitting his use of the drain or may apply lo lhe Municipal Commissioner for authority to use such drain or to be declared joint owner thereof. (3) Every such order bearing lhe signature of lhc Municipal Commissioner shall be a complete auihorily to the person in whose favour it is made or lo any agent or person employed by him Tor Litis purpose, afier giving or tendering lo the owner of lhe drain the compensation or rent specified in the said order and otherwise fulfiling as fur as possible, the condiiions of the said order and after giving to the owner of the drain reasonable written noticc of his intention so to do, lo enter upon the land in which lhe said drain is situate with assistants and workmen al any time between sunrise and sunset and, subjeel to Lhe provisions of ihis AcL, to do all such things as may be necessary for— (a) connecting lhe Iwo drains; or (b) renewing, repairing or altering Lhe connection; or (c) discharging any responsibility aiiacliing lo the person in whose favour Lhe Municipal Commissioner's order is made Tor maintaining, repairing, flushing, cleansing or emptying the joinl drain or any pan thereof. (4) In executing any work under this seciion, as liLlie damage as possible shall be done, and lhe owner or Lhe occupier of lhc premises for the benefit of which lhe work is done shall— (a) cause llie work to be executed with Lhc least practicable delay; (b) fill in, reinstate and make good, at his own cost and with the least practicable delay, the ground or portion of any building or olher conslruction opened, broken up or removed for Lhe purpose of executing the said works; (c) pay compensation to any person who sustains damage by Lhe execution of lhe said work.
