'(1) The Municipal Commissioner may supply waler for any purpose, oilier lhan domestic purpose, oil receiving a wxillen application specifying the purpose Tor which lhe supply is required and llie quantity likely to be consumed: Provided lhai llie payment of any fee for Llic supply of waler under this sub-section shall he made al such rale as may be fixed by regulations or as siaied in the budgel estimate under sub-section (3) of seciion 131: 702 The Kolkuln Municipal Corporalion Act, I9S0. -Provided further iliat where there is no connection lor supply of water lo lhe premises from lhe service mains of the Corporation, llie fee for llie supply of water for non-domestic purpose may be levied on the basis of consumption at such rale as may be determined by regulations: *|Provided also] that till such lime as llie Corporation provides any wuicr-mcler and ailaches llie same to the supply pipe in any premises or building connected wiih ihe service mains or lhe Corporalion. or where such water-meter goes out of order, or where iliere is a dispute about the proper operation of such water-meter, the fee for llie supply of water under this sub-section may be levied on the basis of ihe size of the ferrule attached to die supply pipe in such premises or building. J(2) .Subject to the provisions of sub-scclion (I}, when an application under lhai sub-section is approved, the Municipal Commissioner may by order place or allow lo be placed llie neuessury pipes and waler fittings of such dimension and character as may be specified in the order. ■ J(3) Notwithstanding anything contained in sub-section (1) or elsewhere in this Act. lhe Municipal Commissioner, on receipt of any information lhai lhe waler supplied under lhai sub-section is being consume for any purpose other than the purpose specified in the application thereunder, may, without prejudice to any olher action which he may be entitled to lake under ihis Acl, levy fee for such consumption of waler at such rate as staled in lhe budgel estimate under sub-section (3) of seciion 13J, with efTecl from such dale as lhe Municipal Commissioner may determine: Provided thai no such Tee shall be levied under ihis sub-scciion without giving the person concerned an opportunity i>f being heard.
