No payment of any sum out of the Municipal Fund shall be made unless such expenditure is covered by a current budget gram and a sufficient balance of such budget grant is available notwithstanding any reduction or transfer thereof under the provisions of this Act: Provided dial this section shall nol apply to payments in the following cases:— (a) refund of taxes and other moneys which arc authorised by this Acl; (b) repayment of moneys belonging lo contractors or oilier persons and held in deposit and all moneys collected or credited to the Municipal Fund by mistake: (e) temporary payments for works urgently required by ihe Siate Government in the public interest; (d) sums payable as compensation under this Acl or the rules or lhe regulations made (hereunder; (e) expenses incurred by the Corporaiion on special measures on ihe outbreak of dangerous diseases; (f) sums payable— (i) under orders of the Slnte Government on failure of the Corporation to lake any action required by lhe State Government; or (ii) under any other enactment in force for the time being; or (iiij under llie decrcc or order of a civil or criminal court - against lhe Corporation; or (iv) under a compromise oT any claim, suit or other legal proceedings; or (v) on accuunt of the cost incurred in taking immediate action by any of lhe municipal authorities lo aven a sutlden Ihreai or danger to the property of lhe Corporation or to human life; and (g) such other cases as may be prescribed, 12S, Whenever any sum is paid in any of the cases referred lo in the proviso lo seclion 127, lhe Municipal Commissioner shall forthwith communicale the circumstances ciTsuch paymeni lo theMayor-in-Couricil, and thereupon lhe Mayor-in-Council may lake or recommend io llie The Kolkata Municipal Corporation Act, 1980. 94 LIX of 1980-1 Tcmprirary p.iymtnls Irniii the Municipal Fund for worLs urge inly rcquiicd in lhc public inlcresl.
