When under the provisions of this Chapter, or Chapter VII, the General Manager may require the owner of any premises to carry out any work, he may, if he considers it desirable so to do, require the occupier of the said premises to carry out such work and the occupier shall be bound to comply with the requisition : Provided that except in the case of a special agreement to the contrary, such occupier may deduct the amount of the expenses reasonably incurred or paid by him in respect of such work from the rent payable to the owner or may recover the same from him in any court of competent' jurisdiction: Provided further that for the purpose of clause (b) of section 9 of the West Bengal Premises Tenancy Act, 1956, an occupier who is a tenant shall be deemed to have given his written consent to any expenditure incurred for any work done in pursuance of Chapters VII and VIII of this Act which amounts to an improvement within the meaning of the said West Bengal Premises Tenancy Act, 1956. 27 Regula- tions as is drains, privies and urinals.
