(1) Whoever contravenes the provisions of sections 34, 35, 36, 37 or 41of this Act shall, without prejudice to the provisions of section 46 of this Act, be punishable with imprisonment for a term which shall not be less than three years but which may extend to seven years and with fine, which may extend to five lacs rupees, but shall not be less than fifty thousand rupees. (2) Where a conviction is made under sub-section (1), the court may, in addition to awarding any punishment under that sub-section, by order in writing, require the Institution or any other person convicted to refund the money so collected in excess to the person, from whom it was collected, within such period as may be specified in the order.
