( 1) A person shall be disqualified for election or nomination as a member of any authority or body of the University or shall continue as such member if he is- (i) is not a citizen of India, or (ii) is of unsound mind or a deaf-mute, or (iii) is an undischarged insolvent, or (iv) has been convicted by a Court of law for an offence involving moral turpitude. (2) In case of any doubt or dispute, the Amir-i-Jamia (Chancellor)'s decision, whether a person is disqualified under the provision of sub-section (1) shall be final. (3) No persons shall be entitled to stand as a candidate for election to any authority_ or body ?f the University from more than one constituency. (4) No persons shall be entitled to be enrolled as a voter for, or to cast his/her vote at, an election to· any authority or body of the University from more than one constituency: Provided that this sub-section shall not apply in the case of an election of members of the Darbar-i-Aliah (Court), the Majlis-i-Muntazimah (Executive Council) or Majlis-i-Talimi (Academic Council). (5) Notwithstanding anything contained elsewhere in this Act, no person shall- (i) if he is teacher, not holding any whole-time teaching post, ot appointed for a specified period, or · (ii) ifhe is a member of the non-teaching staff, not appointed on a regular scale of pay, or not holding any whole-time non-teaching post, be entitled to be enrolled as a voter for, or to cast his vote at, ·an election to any authority or body of the University or to be nominated to any such authority or bo~y. Explanation:-"regular scale of pay" shall mean pay which, subject to any condition prescribed by the University, rises by periodical increment from a minimum to a maximum.
