Substituted by see, 5 (iii) ibid. 131 [The Uttar Pradesh Pravidhik Shiksha Adhiniyam, 1962] [Section 15-17] (2) If the Board fails to take action within a reasonable time to the satisfaction of the State Government or fails to communicate the action taken or proposed to be taken, the State Government may, after considering any explanation furnished or re-presentation made by the Board, Issue such directions consistent with the provisions of this Act and the rules and regulations made thereunder as it may think fit. The Board shall comply with the said directions within the time-specified therein and if it fails to do so the State Government may take all such steps as it may deem necessary to give effect to such directions. [(3) Notwithstanding anything in sub-sections (1) and (2) the State Government, in any emergency which In its Opinion requires that immediate' action should be taken, may, without prior reference to the Board, issue such directions or take such other action consistent with the express provisions of this Act as it may think fit]l. Powers and duties of the Chairman 15- (1) The Chairman shall, subject to the superintendence control and directions of the Board, have the power to do all acts required for implementing the decisions of the Board and shall exercise such other powers and perform such other duties as may be prescribed by rules. . (2) The Chairman shall, subject to the superintendence control and directions of the Board, have power to make such orders on the decisions of the committees constituted under sub-section (1) of section 18, as may be within the jurisdiction of the Board and as he may deem fit. The Chairman shall inform the Board of every such order at its next meeting. (3) The Chairman may in an emergency, which in his opinion, requires that Immediate action should be taken, deal with any matter within the competence of the Board and, subject to the provisions of this Act, the rules and regulations made thereunder by order in writing take such action as he may deem necessary. The Chairman shall thereupon forthwith inform the Board, at its next meeting, of the action so taken. (4) The Board may, subject to the provisions of sub-section (3) of section 14, confirm, set aside or modify the order passed by the Chairman under sub-section (2) or (3), and pass such other orders as may be considered expedient or necessary in regard to matters arising from the action taken by him. (5) Any action taken or order passed, by the State Government under sub- section (3) of section 14, whether in respect of any matter dealt with by the Chairman under, sub-section (2) or (3) or otherwise, shall be final and be not questioned before any court of law and shall prevail over any order passed by the Chairman or the Board under this section. Powers and duties of the vice-Chairman 16- The Vice-Chairman shall exercise such powers and perform such duties of the Chairman as may be prescribed by rules or delegated to him by the Chairman. Powers and duties of the Secretary 17- The Secretary shall be the Chief Executive Officer of the Board and shall, subject to the superintendence, control and directions of the Board, be responsible for the execution of its decisions.
