Subs. by section 2 of Uttarakhand Act No. 13 of 2002. 186 [The [Uttar Pradesh]2 Municipalities Act, 1916] [Section 9A] (b) The ex-officio members, comprising all members of the House of People and State Legislative Assembly representing constituencies which comprise wholly or partly municipal area; (c) The ex-officio members, comprising all members of the Council of States and t State Legislative Council who are registered as electors within the municipal area; [(d) Nominated members, who shall be nominated by the State Government, notification in the Official Gazette, from amongst persons having special knowledge experience in municipal administration and whose numbers shall in the case of- (i) Nagar Panchayat, be not less than two and not more than seven; (ii) Municipal Council, be not less than three and not more than nine; Provided that the representation of following clases shall provide necessarily in t nominated members by State Government:- (1)Scheduled Castes/Scheduled Tribes; (2)Woman; (3) Other Backward Classes; (4)Minority Communities.] (e) The Chairperson of the committees, if any, established under Section 104, if th are not members under any of the foregoing clauses : Provided that the persons referred to in clause (d) shall hold office during the pleasu of the State Government and they shall have the right to vote in the meetings of t Municipalities. Provided further that any vacancy in any category of members referred to in claus (a) to (e) shall be no bar to the constitution or reconstitution of a municipality.]1 [Reservation of seats 9-A (1) In every municipality seats shall be reserved for the [Scheduled Castes, t Scheduled Tribes and the Backward Classes]3 and the number of seats so reserved shall be as nearly as may be, the same proportion to the total number of seats to be filled by dire election in that municipality as the population of the Scheduled Castes in the Municipal ar or of the Scheduled Tribes in the Municipal area [or of the Backward Classes in the Municip area]4 bears to the total population of such area and such seats may be allotted by rotation different wards in a municipality in such order as may be allotted by rotation to differe wards in a municipality in such order as may be prescribed by rules : [Provided that the reservation for the Backward Classes shall not exceed [fourteen percent of the total number of seats in the municipality : Provided further that that if the figures of population of the Backward Classes are n available, their population may be determined by carrying out a survey in the mann prescribed by rules.]5 (2) [***]6
