(1) The [District Judge]2 may declare any candidate found to have committed any corrupt practice to be incapable, for any period not exceeding five years, of being elected as a member of the [Municipality]3 or of being appointed or retained in any office or place in the guilt or disposal of the [Municipality]3 : Provided that no such declaration shall be made about any candidate who was not a party to the election petition or who was not given an opportunity of being heard under section 26.
